These Terms of Service ("Terms") govern access to and use of the JustPost platform and related services ("the Service").
By creating an account, accessing the platform, or using any part of the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Service.
These Terms form a legally binding agreement between FairSay Ltd and the organisation or individual using the Service ("Customer").
Individuals participating in campaigns created by Customer organisations are also subject to any additional terms, notices or privacy information provided by that Customer.
JustPost is a principled participation platform operated by FairSay Ltd, a company registered in England and Wales under company number 5244802. It enables organisations to create campaigns that support lawful public participation and advocacy, including sending postcards, letters and other printed communications.
FairSay operates JustPost as a curated platform and applies ethical standards to organisations and campaigns using the service.

JustPost provides organisations with an online platform for creating, managing and delivering printed advocacy and engagement campaigns, including postcards, letters and other printed communications.
JustPost exists to help organisations engage supporters and decision-makers through professionally produced printed communications.
The platform provides campaign management, supporter participation, moderation, payment processing, printing coordination, reporting and related services.
JustPost is intended for lawful campaigning, advocacy, public participation and community engagement activities conducted in accordance with these Terms, the Ethical Policy and applicable law.
JustPost is designed to support lawful public participation and advocacy.
FairSay operates JustPost as a principled participation platform. This means we apply ethical standards to the organisations and campaigns that use the service.
Organisations wishing to use JustPost may be required to undergo review before access is granted.
FairSay may consider:
Acceptance onto the platform does not mean that FairSay endorses every statement, opinion or campaign message published by a customer. It means that FairSay considers the organisation and campaign to be consistent with the purpose and policies of JustPost.
For the purposes of these Terms:

Where a separately negotiated written agreement exists between FairSay Ltd and a Customer, that agreement shall take precedence over these Terms to the extent of any inconsistency.
Access to JustPost is subject to approval by FairSay Ltd.
Organisations wishing to use the Service may be required to provide sufficient information to enable FairSay to assess whether the proposed use is consistent with the purpose of the platform, these Terms, the Ethical Policy and applicable law.
FairSay reserves the right, at its sole discretion, to approve or refuse applications for access.
Approval of an organisation does not automatically constitute approval of every Campaign created by that organisation. Approval of an organisation or previous Campaign does not guarantee approval of future Campaigns.
FairSay may require additional information or clarification before approving a Campaign.
FairSay may refuse, suspend or terminate access to the Service where it reasonably believes continued operation would expose the platform, its users, FairSay or third parties to unacceptable legal, operational, security or reputational risk.
Customers entering into these Terms confirm that they have authority to act on behalf of the organisation they represent.
Users must be at least 18 years of age or otherwise authorised by their organisation to use the Service.
Campaign participants may be subject to separate age requirements determined by the Customer responsible for the Campaign.
Each Customer Account is established for use by the approved organisation.
Individual Users must have their own login credentials.
Account sharing is prohibited.
Customers are responsible for:
Multi-factor authentication is required for Customer dashboard accounts where supported by the Service.
Customers remain responsible for all activity carried out using their authorised accounts.

Customers remain responsible for all Campaign content submitted through the Service, whether created by their own staff, volunteers or Participants.
Customers and Users must use the Service responsibly and must not:
FairSay may investigate suspected breaches of these Terms and take appropriate action, including suspension or termination of access to the Service.
All Customers and Campaigns must comply with the JustPost Ethical Policy.
FairSay may request additional information where necessary to determine whether a proposed Campaign complies with the Ethical Policy.
Failure to comply with the Ethical Policy may result in refusal, suspension or termination of access to the Service.
Nothing in these Terms limits FairSay's right to refuse or discontinue the provision of Services where continued operation would conflict with its Ethical Policy or applicable law.
Customers are responsible for all Campaigns created using the Service, including campaign configuration, recipient information, messages, images, uploaded files and any other materials submitted through the Platform.
Customers warrant that they have all necessary rights, permissions and authority to submit Campaign content and to instruct FairSay Ltd to process, print and distribute that content on their behalf.
Customers are responsible for ensuring that Campaign content:
FairSay is not responsible for verifying the factual accuracy of Campaign content submitted by Customers.
Where the Service enables Participants to submit messages, images or other content, Customers acknowledge that such submissions originate from Participants.
Depending on the configuration of a Campaign, Participant content may be:
Customers remain responsible for determining the moderation settings appropriate for their Campaigns.
Customers retain ownership of all Campaign content, Customer Data and other materials submitted through the Service.
Participants retain ownership of content they create, subject to any rights granted to the Customer operating the Campaign.
Customers grant FairSay Ltd a limited, non-exclusive, worldwide licence to host, store, reproduce, adapt where technically necessary, transmit, print and otherwise process Campaign content solely for the purposes of:
This licence continues only for as long as reasonably necessary to provide the Service and meet applicable legal, contractual and regulatory obligations.
Nothing in these Terms transfers ownership of Customer Data or Campaign content to FairSay Ltd.
FairSay provides moderation tools to help Customers manage Campaign content.
Moderation may be undertaken by authorised human reviewers and, where available and enabled by the Customer, approved automated moderation tools.
FairSay reserves the right to review Campaign configuration, submitted content and uploaded materials before or after publication where reasonably necessary to:
FairSay may refuse, suspend, remove or require amendment of Campaign content that it reasonably believes:
Where reasonably practicable, FairSay will explain the reason for significant moderation decisions to the Customer.
The JustPost Service includes the preparation and coordination of printed communications.
Printing and postal fulfilment are carried out by approved third-party providers acting under FairSay's instructions.
Customers acknowledge that:
Estimated production and dispatch times are provided for guidance only and are not guaranteed.
FairSay is not responsible for delays or failures caused by postal operators, customs authorities, recipient availability or events outside FairSay's reasonable control.
Charges for the Service are communicated through quotations, invoices, customer agreements or the Platform.
Unless otherwise agreed in writing:
Online payments are processed by approved third-party payment providers. FairSay does not receive or store payment card numbers, security codes or other sensitive payment credentials.
Payment processing is subject to the terms and conditions of the relevant payment provider.
Where the Service provides JustPost Credits, these represent prepaid credits that may be used only to purchase eligible JustPost services.
JustPost Credits are not money held on account, bank deposits, electronic money, payment accounts or financial products. They cannot be transferred, exchanged for cash or withdrawn, except where required by applicable law or expressly agreed by FairSay in writing.
JustPost Credits may be subject to published terms regarding their purchase, use, validity period and expiry. FairSay reserves the right to amend the availability, functionality or terms relating to JustPost Credits where reasonably necessary to operate the Service, comply with legal requirements or improve the Platform.
The JustPost Platform, including its software, design, branding, documentation, databases and underlying technology, remains the intellectual property of FairSay Ltd or its licensors.
Except as expressly permitted by these Terms, Customers may not:
Nothing in these Terms transfers ownership of FairSay intellectual property to Customers.
FairSay Ltd is committed to protecting personal data and complying with applicable data protection legislation.
The respective responsibilities of FairSay Ltd and Customers depend upon the role being performed in relation to each Campaign.
In most cases:
Where FairSay operates its own Campaigns, FairSay acts as the Data Controller.
Processing of personal data is governed by the JustPost Privacy & Data Protection Policy and, where applicable, a separate Data Processing Agreement.
Customers are responsible for ensuring that they have an appropriate lawful basis for collecting and processing personal data through their Campaigns.
FairSay implements appropriate technical and organisational measures designed to protect the confidentiality, integrity and availability of the Service and Customer Data.
Customers are responsible for protecting their own account credentials, managing authorised Users and maintaining the security of devices used to access the Service.
Customers must not:
Responsible security research is welcomed where coordinated with FairSay in accordance with the Security Policy.
Customers who become aware of an actual or suspected security vulnerability affecting the Service should report it promptly to: support@JustPost.pro
FairSay will investigate reported vulnerabilities and respond in accordance with its responsible disclosure process.
Each party agrees to protect confidential information received from the other party and to use such information only for purposes connected with the provision or use of the Service.
This obligation does not apply to information that:
FairSay may permit access to confidential information by employees, contractors and approved subprocessors only where necessary to provide the Service and subject to appropriate confidentiality obligations.
FairSay Ltd designs and operates the JustPost Service to provide a reliable, resilient and secure platform.
However, the Service depends upon third-party infrastructure providers, telecommunications networks and postal services that are outside FairSay's direct control.
Accordingly:
FairSay may suspend parts of the Service where necessary to protect the security, integrity or stability of the Platform.
Where reasonably practicable, FairSay will provide advance notice of planned maintenance that is likely to materially affect Customers.
FairSay continually develops and improves the Service.
Accordingly, FairSay may:
Where changes materially affect Customers, FairSay will use reasonable efforts to provide advance notice.
FairSay is not obliged to maintain every feature indefinitely.
FairSay may suspend or terminate access to the Service immediately where it reasonably believes that:
FairSay may also suspend individual Campaigns while concerns are investigated.
Where reasonably practicable, FairSay will notify the Customer of the reasons for suspension.
Serious or repeated breaches may result in permanent termination of the Customer Account.
Termination under this section does not entitle the Customer to compensation or a refund for Services already provided, work already undertaken or costs already incurred by FairSay.
Nothing in this section limits FairSay's right to recover unpaid fees or other amounts lawfully due.
Customers may terminate their use of the Service by giving reasonable written notice, subject to any separate contractual commitments.
Upon termination:
Customer access to the Platform may be withdrawn;
Campaigns may be disabled;
User accounts may be deactivated;
Customer Data will be retained or deleted in accordance with the Privacy & Data Protection Policy, contractual obligations and applicable law.
Termination does not affect obligations that are intended to survive termination, including obligations relating to confidentiality, payment, intellectual property and liability.
FairSay Ltd will exercise reasonable skill and care in providing the Service.
Nothing in these Terms excludes or limits liability where such exclusion would be unlawful, including liability for:
Except to the extent prohibited by law:
Where permitted by applicable law, FairSay's aggregate liability arising from or in connection with these Terms shall not exceed the total fees paid by the Customer to FairSay during the twelve months immediately preceding the event giving rise to the claim.
Unless these Terms expressly provide otherwise, any indemnity given by FairSay is subject to the limitations and exclusions of liability set out in this Section.
FairSay shall not be liable for delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control.

FairSay will use reasonable efforts to minimise disruption and restore normal operation as soon as reasonably practicable.
Customers are responsible for ensuring that their use of the Service complies with all applicable laws and regulations, including those relating to:
Customers remain solely responsible for determining whether their Campaigns comply with legal requirements applicable to their activities.
The Customer agrees to indemnify and keep FairSay Ltd indemnified against reasonable losses, liabilities, damages, costs and expenses (including reasonable legal costs) arising directly from:
This indemnity does not apply to the extent that any loss results from FairSay's own negligence, fraud, wilful misconduct or breach of these Terms.
FairSay may assign or transfer its rights and obligations under these Terms to another organisation in connection with a business reorganisation, merger, acquisition or transfer of the Service.
Customers may not assign or transfer their rights or obligations under these Terms without FairSay's prior written consent.
These Terms, together with the Related Policies identified in Section 5 and any separate written agreement between FairSay Ltd and the Customer, constitute the entire agreement governing use of the Service.
If any inconsistency exists between these Terms and a separately negotiated written agreement, the negotiated agreement shall take precedence.
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be interpreted to the minimum extent necessary to make it enforceable.
The remaining provisions shall remain in full force and effect.
Failure by FairSay to enforce any provision of these Terms shall not constitute a waiver of that provision or any subsequent breach.
These Terms are governed by and shall be construed in accordance with the laws of England and Wales.
Subject to any mandatory legal rights that cannot be excluded, the courts of England and Wales shall have exclusive jurisdiction to resolve disputes arising under or in connection with these Terms.
FairSay may update these Terms from time to time to reflect:

Material changes affecting Customers will be communicated using reasonable means before taking effect where practicable.
Continued use of the Service following the effective date of updated Terms constitutes acceptance of those changes.
